Potential Penalties for Driving on a Suspended License

  • A fine of between $500 and $1,000 for the first offense
  • A fine of between $1,000 and $4,000 for the second or any subsequent offense
  • Thirty days to six months in jail for the first offense
  • Sixty days to one year in jail for the second or any subsequent conviction for driving on a suspended license
  • Doubling of the term of the initial suspension
  • Additional enhancements for driving on an alcohol-related license suspension

Delaware law provides stiff mandatory penalties for individuals convicted of driving on a suspended or revoked license.  For a first offense, the $500 fine is mandatory, although the jail sentence can be waived by the judge.  If you are convicted of a subsequent offense, at a minimum you will pay a $1,000 fine and spend 30 days in jail.

Drivers who have been labeled habitual offenders by the court can face even stiffer penalties for driving on a suspended license, including fines ranging from $1,150 to $2,300 and jail or prison time from ninety days up to five years.
